This case is about the cyberattack on Omni Healthcare's network in January 2024, wherein an unauthorized third party accessed certain files on Omni Healthcare's network (the "Data Incident"). These files may have contained personal information such as names, dates of birth, demographic information, Current Procedural Terminology ("CPT") codes, medical record numbers, treatment and diagnosis information, dates of treatment, provider names, and/or sleep study details and results; and in some instances, Social Security numbers, health insurance, and/or financial account information. Settlement benefits: Cash Payment A – Documented Out-of-Pocket Losses: reimbursement up to $5,000.00 per Settlement Class Member for actual, documented out-of-pocket losses due to the Data Incident occurring between January 18, 2024, and September 3, 2026. Cash Payment B – Alternate Cash: one-time cash payment of $40.00 (no proof required). All Class Members also eligible for three years of CyEx Medical Shield Complete with $1 million medical identity theft insurance. The only way to receive benefits or payments from this Settlement is by submitting a valid and timely Claim Form. ... If you do nothing, you will not receive benefits or payments from this Settlement and you will give up the right to sue, continue to sue, or be part of another lawsuit against the Defendant related to the legal claims resolved by this Settlement.

Who may qualify

All individuals in the United States whose Private Information was impacted by the Data Incident, including all those who were sent notice of the Data Incident by Defendants.
