Kroger is accused of reporting its higher retail prescription prices to insurers as its "usual and customary" (U&C) price instead of the lower price available through its own Rx/Health Savings Club program, causing insured customers to pay more in copays than they should have. After five years of litigation — including a 3-day evidentiary hearing and class certification granted April 9, 2025 — Kroger agreed on March 12, 2026 to a non-reversionary $17,000,000 cash fund without admitting wrongdoing. "Kroger" for this settlement covers every one of its pharmacy banners, not just stores branded Kroger: Baker's, City Market, Dillons, Food 4 Less, Foods Co, Fred Meyer, Fry's, Gerbes, Jay C Food Store, King Soopers, Mariano's, Metro Market, Pay-Less Super Markets, Pick'n Save, QFC, Ralphs, Ruler, and Smith's Food and Drug.

Verbatim mechanism from the court-filed Plan of Allocation and Distribution (paragraphs 5-11): each claimant's "Recognized Claim" is based on the estimated or actual dollars they spent on Kroger prescriptions filled with insurance during the Settlement Class Period, bucketed into bands and VALUED AT THE TOP of the band — $1-500 claims are valued at $500; $501-1,000 at $1,000; $1,001-4,000 at $4,000; $4,001-7,999 at $7,999; and $8,000+ at the documented actual amount. "Known Claimants" (people on Kroger's own list of insured prescription purchasers) can claim under $8,000 with just an attestation — no documentation required. "Unknown Claimants" (not on that list) must always submit Claim Documentation (itemized receipts, cancelled checks, bank/credit-card statements, insurance records, etc.) regardless of amount, and so must any Known Claimant claiming $8,000 or more. Each Authorized Claimant's final Distribution Amount = (their Recognized Claim divided by the sum of everyone's Recognized Claims) times the Net Settlement Fund — so the per-person dollar figure cannot be known until all claims are in; paid via Zelle, PayPal, Venmo, ACH, or check (180 days to cash a check).

Who may qualify

Verbatim class definition, Settlement Agreement section 1.38: "All individuals in the United States and its territories who, at any point in time during the Settlement Class Period, paid in whole or in part for one or more prescription drugs from Kroger using their insurance." The Settlement Class Period (section 1.37) runs "from December 9, 2018 through the date on which Class Notice is disseminated" — that notice date is not yet fixed, so the end of the eligibility window cannot be stated as a specific date today. Excluded (section 1.38): presiding judges and their staff/families; Kroger officers, directors and controlled affiliates; anyone who validly opts out; and anyone who separately sued or arbitrated Kroger over the same U&C-pricing conduct.

Angeion Group also administers the unrelated Costco WA settlement above under a different site — no connection between the two cases beyond sharing an administrator. Unresolved: the Documents page lists "Plaintiffs' Unopposed Motion for Preliminary Approval" but no entered "Order Granting Preliminary Approval" was found among the pages fetched — the fact that concrete deadlines are already published on the site strongly implies preliminary approval has been granted, but this is inferred, not confirmed from an order with an entry date. Do not promote to live until: (1) the online Claim Form is actually submittable, (2) the Class Notice dissemination date is known, (3) claim_form_url is captured, (4) FAQ content exists on the site to pull (none does as of 2026-07-21).
